2. What information we collect

We collect and use personal information about you.

We (and the vendors and other parties that perform services on our behalf) may collect, receive, and develop several different types of personal information about you depending on the nature of your interactions with us, which we have grouped together as follows:

If you choose to provide User Content, it may be made available on public areas of our website or on or through our social media channels.

 

  • Location Information. Examples include your precise geolocation when you access the mobile version of our website, including by using GPS and WiFi technology. We also collect information about your general location using your IP address and your zip code, such as when you search online for product retailers near you, for example.

 

  • Employment-Related Information. Examples include, if you apply for a job, your work experience and previous employment, your education history, your resume, the URL to your personal or professional websites, your workplace skill sets and certifications, whether you need a visa to work in the United States, and salary expectations. If you apply for a job, you can choose to also voluntarily provide any of the following information: ethnicity, gender, disability status, and/or veteran status. Some of the information we collect about you may be personal information, or personal data, that can be used to identify you including, for example, your name, email address, mailing address or delivery address. In some jurisdictions, certain unique identifiers like IP addresses and other usage or technical information may be considered personal information. Personal information does not include data where your identity has been removed so that we can no longer identify you (anonymous data), which we may use for any purpose.

3. Children’s online privacy

Our Website is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Website or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. 4. How we collect your information

We collect personal information about you from various sources, directly and indirectly.

We collect information from and about you in the following ways:

  • When you provide it to us. You may give us information about you by filling in forms (including, without limitation, pop-up forms, forms in our footers and on our checkout page) or by communicating with us by email or otherwise. This includes information you provide when you register for an account, subscribe to one of our newsletters or other communications, enroll in any loyalty program we have now or in the future, place an order, participate in one of our events, write a review, or when you otherwise contact us about our website, products, or services. We may use information that is not personal information for any purpose. For example, we may aggregate usage data from many people in a way that does not identify any individuals to calculate the percentage of users accessing a feature on the website.

We share information with other parties.

We may share non-personal information without restriction. We may share your personal information with:

  • Any member of our corporate group, which means our subsidiaries, affiliates, our ultimate holding company and its subsidiaries, and affiliates.

9. Third Party Content, Apps, and Links

Some content or applications on our websites may be served by third parties, content providers and application providers including the following:

  • Plugins. Our websites make available the option for you to use “plugins” that are operated by social media companies. If you choose to use one of these plugins, then it may collect information about you and send it back to the social media company that owns it. This may happen even if you do not click on the plugin, if you are logged into the social media website that owns the plugin when you visit our website. Information collected by a plugin is subject to the privacy policy and terms of the social media company that makes it. If you do not want the social media company who owns a plugin to collect information about you when you visit our websites, sign out of the social media network before visiting. By interacting with a plugin when you are on our websites (for example, clicking the Facebook “Like” button), you are intentionally transferring information to that social media company. Further, if you are logged into a social media website when you visit our websites, then you are directing us to share your data with the social media company that owns the plugin.
  • User Content. Our websites may allow you to upload your own content to public areas of the website. Any information you submit becomes public information, and we do not control how others may use the content you submit. We are not responsible for uses that may violate our privacy policy, the law, or your intellectual property rights.
  • Third-party links. Our websites may contain links to other sites, which we do not control. Those websites have their own privacy policies and terms.

10. Your Rights and Choices

You can opt-out of receiving marketing emails. To stop receiving our promotional emails, follow the instructions in any promotional message you get from us. Some of our websites allow you to modify your preferences to opt-out. Even if you opt-out of getting marketing messages, we will still send you transactional messages, such as responses to your questions.

Your rights may vary depending on where you are located. We have created mechanisms to provide you with the following control over your information.

Flash cookies are not managed by the same browser settings as are used for browser cookies. 11. Data Security

We rely on Shopify’s platform and security measures to protect your data. All information you provide to us is stored on secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

12. Nevada privacy rights

Nevada residents have the right to opt out of the sale of certain "covered information" collected by operators of websites or online services. We currently do not sell covered information, as "sale" is defined by such law, and we do not have plans to sell this information.

13. Canada privacy

Your personal information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the data, including personal information, to United States and process it there.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy notice and no transfer of your personal information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses.

  • Lawful basis

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

    • Where we need to perform the contract, we are about to enter into, or have entered into with you.
    • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests, potentially including uses such as determining the internal analytics of the Products and Services and for determining marketing performance to share relevant information and offers about our products with customers and potential customers.
    • Where we need to comply with a legal obligation.
    • Generally, we do not rely on consent as a legal basis for processing your personal data although we will get your consent before sending third party direct marketing communications to you. You have the right to withdraw consent to marketing at any time by contacting us.

We reserve the right to verify the truthfulness of personal data provided at any time.

We do not use any type of automated process for profiling purposes.

  • Data retention

We will only retain your personal data for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements. In any event, we do not intend to hold the data for more than five years.

15. Copyright Infringement

We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe any materials accessible on or from our services infringes your copyright, you may request removal of those materials (or access to them) from the services by submitting written notification to our Copyright Agent that is designated below. It is eLo’s policy to terminate the accounts of repeat infringers.

In accordance with the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”), the written notice (the “DMCA Notice”) must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the copyrighted work you believe to have been infringed or, if the claim involves multiple works on the services, a representative list of such works.
  • Identification of the material you believe to be infringing in a sufficiently precise manner to allow us to locate that material.
